  • 2. The entity operating the Website and providing the accommodation service is [do-uzupełnienia], with its registered office or business address at [do-uzupełnienia], Tax Identification Number (NIP): [do-uzupełnienia], registration details: [do-uzupełnienia], hereinafter referred to as the “Accommodation Provider” or “Service Provider”.

  • telephone number: [do-uzupełnienia];

  • 5. These Terms and Conditions are made available on the Website free of charge before a booking is made, in a manner enabling them to be saved, reproduced and stored.
  • 6. These Terms and Conditions apply to persons using the Website and to Customers making bookings. In the event of a conflict between these Terms and Conditions and an individual booking confirmation, individually agreed terms expressly confirmed by the Accommodation Provider shall prevail, subject to mandatory provisions of law.
  • 7. Matters not covered by these Terms and Conditions are governed by Polish law, in particular the Civil Code, the Act on Consumer Rights, the Act on the Provision of Services by Electronic Means and, where applicable, the provisions concerning hotel services.

§ 2. Definitions

  • 1. Website – the website available at the address indicated in § 1(1), through which users can view the offer for the Holiday House, check availability and place a booking.
  • 2. Accommodation Provider – the entity indicated in § 1(2), providing the accommodation service.
  • 3. Customer – a natural person, legal person or organisational unit granted legal capacity by law, who uses the Website or makes a booking.
  • 4. Consumer – a natural person entering into a legal transaction with the Accommodation Provider that is not directly related to that person's business or professional activity.
  • 5. Individual entrepreneur with consumer rights – a natural person entering into an agreement directly related to their business activity where the agreement does not have a professional nature for that person, to the extent that the applicable provisions grant them protection equivalent to that of a consumer.
  • 6. Guest – the Customer or another person named in the booking who is entitled to stay at the Holiday House during the booked period.
  • 7. Booking – an action performed using the form on the Website, including selecting dates, providing the required details and submitting an order for accommodation services.
  • 8. Agreement – an agreement for paid use of the Holiday House for a recreational stay during a specified period, concluded through the Website.
  • 9. Stay Price – the total price for accommodation during the selected period, including all mandatory charges that can be determined before the Booking is submitted.
  • 10. Payment Operator – an external entity processing electronic payments available on the Website, whose details are provided when a payment method is selected.

§ 3. Type and scope of services provided electronically

  • 1. Through the Website, the Service Provider offers the following services by electronic means free of charge:
  • a) providing information about the Holiday House, available dates, prices and stay conditions;
  • b) making a booking form available;
  • c) enabling the Customer to submit a Booking and proceed to electronic payment;
  • d) sending messages related to the Booking, payment, Agreement confirmation and Customer service;
  • e) enabling contact with the Accommodation Provider using the available contact details or a contact form, if one is provided.
  • 2. A Booking does not require the Customer to create an account or register. Bookings are made through a form without creating a user account.
  • 3. Electronic services are provided for the time the Customer uses the relevant Website functions or until the relevant enquiry or Booking has been handled, depending on the nature of the service.
  • 4. The Customer may stop using free electronic services at any time, in particular by closing the Website. The Customer may also request that handling of a form or enquiry be discontinued by contacting the Accommodation Provider. Ceasing to use the Website does not affect obligations under an Agreement already concluded.
  • 5. It is prohibited to submit unlawful content through the Website, content infringing third-party rights or good practice, or to take actions that disrupt the Website, including attempts to gain unauthorised access to its systems.
  • 6. The Service Provider endeavours to ensure that the Website operates correctly. Temporary unavailability or limited functionality may occur due to technical work, maintenance or the operation of external service providers. This does not affect the Customer's rights under an Agreement already concluded.

§ 4. Technical requirements and security

  • 1. The following are required to use the Website:
  • a) a device with Internet access;
  • b) an up-to-date web browser supporting the standards used by the Website;
  • c) an active email address, needed to receive the Booking confirmation and communicate about the Agreement;
  • d) JavaScript and cookies enabled to the extent necessary for the proper functioning of the form and booking process.
  • 2. No special software installation is required. If the Website provides documents in a format requiring additional software, relevant information will be provided with the document.
  • 3. The Customer should use up-to-date software and apply basic measures to protect their device against malware and unauthorised access.
  • 4. Consent to analytics cookies is not a condition for using the basic booking functions. Cookies and similar technologies that require consent under applicable law will only be activated after the required consent has been obtained.

§ 5. Information about the Holiday House, availability and prices

  • 1. Before making a Booking, the Customer should review the description of the Holiday House, its equipment, location, amenities, restrictions and stay rules.
  • 2. Availability shown in the booking form is updated based on the booking system. If a technical error results in two bookings being accepted for the same dates, the Accommodation Provider will contact the Customer promptly to agree on a solution. If the Agreement cannot be performed, the Accommodation Provider will refund the payment for the stay that cannot be provided, without prejudice to the Customer's other statutory rights.
  • 3. Prices on the Website are quoted in Polish zloty (PLN), unless expressly stated otherwise. Before submitting a Booking, the Customer is shown the total price for the stay, including all mandatory fees and taxes.
  • 4. Services included in the Stay Price: [do-uzupełnienia].
  • 5. Additional charges, if any, their amount or calculation method and payment date: [do-uzupełnienia]. All mandatory charges must be shown to the Customer before the Booking is submitted and included in the total price.
  • 6. If the Customer orders an additional, optional service after the Agreement has been concluded, the price will be shown before the order is placed. No additional payment will be charged on the basis of preselected options without the Customer's express consent.
  • 7. The Accommodation Provider settles taxes and issues sales documents in accordance with applicable law. These Terms and Conditions do not determine whether a particular service is exempt from VAT; the tax status of the Accommodation Provider and the service is determined under the applicable provisions.

§ 6. Placing a Booking and conclusion of the Agreement

  • 1. A Booking may be made using the form available on the Website for dates shown as available.
  • 2. To submit a Booking, the Customer:
  • a) selects the arrival and departure dates and an available stay option;
  • b) specifies the number of Guests and other information required to provide the stay;
  • c) provides the required contact and billing details;
  • d) reviews the Stay Price and the payment and cancellation conditions;
  • e) reads these Terms and Conditions and confirms having read them if the form requires a separate confirmation;
  • f) submits the order using a button clearly indicating the payment obligation, e.g. “Book and pay” or “Order with obligation to pay”.
  • 3. The Customer must provide accurate, complete and up-to-date information and is responsible for the correctness of the email address and other information required to make the Booking.
  • 4. The Agreement is concluded automatically when all of the following conditions are met: (i) the Customer correctly submits the order through the form, (ii) the Payment Operator confirms successful payment of the full Stay Price, and (iii) the booking system confirms acceptance of the Booking. The Booking confirmation is sent to the Customer's email address on a durable medium, in particular in the body of an email or as an attachment.
  • 5. The confirmation email includes at least the Booking details, stay dates, number of Guests, Stay Price, payment information, the Accommodation Provider's contact details and the cancellation terms and key stay rules.
  • 6. Merely completing or submitting the form without successful completion of payment does not mean that the Agreement has been concluded, unless the system expressly informs the Customer of another method of conclusion. If payment is not completed, the selected dates may be released after the following period: [do-uzupełnienia].
  • 7. If the Customer does not receive a confirmation, they should check their spam/promotions folder and contact the Accommodation Provider. The absence of a confirmation email should not be taken to mean that the Booking has been successfully concluded.
  • 8. The Agreement is concluded in Polish. If the Website enables Agreements to be concluded in other languages, information about this will be provided before the Booking is made.

§ 7. Payments

  • 1. The full Stay Price must be paid in advance when making the Booking, using a payment method available on the Website.
  • 2. Available payment methods: [do-uzupełnienia].
  • 3. Payments may be processed by a Payment Operator acting under its own terms of service. The Operator's documents and the Accommodation Provider's Privacy Policy govern the processing of data by the Operator.
  • 4. The Booking becomes binding in accordance with § 6(4) after successful payment of the full Stay Price has been confirmed.
  • 5. If the Payment Operator rejects the transaction or payment is not confirmed, the Agreement is not concluded and the Customer will receive an appropriate message, if supported by the system.
  • 6. No security deposit is collected for the stay. This does not release the Guest from liability for damage under applicable law.
  • 7. At the Customer's request, the Accommodation Provider will issue an invoice if required or permitted by law. The Customer should request an invoice and provide the information required by law, including a tax identification number if the invoice is to be issued to a business.

§ 8. Rules for staying at the Holiday House

  • 1. The stay is permitted only during the booked period and for the number of Guests stated in the Booking confirmation, subject to the maximum occupancy specified in the description of the Holiday House.
  • 2. Check-in starts at [do-uzupełnienia] and check-out must take place by [do-uzupełnienia]. Early check-in or late check-out must be agreed with the Accommodation Provider in advance and may involve an additional charge if its amount was disclosed before the service was ordered.
  • 3. The method of handing over keys or access codes and directions to the property: [do-uzupełnienia]. The Customer must not share access codes or keys with unauthorised persons.
  • 4. The maximum occupancy of the Holiday House is [do-uzupełnienia]. Additional persons require the Accommodation Provider's consent and may incur an additional charge if disclosed in advance.
  • 5. Pets are permitted. The Customer is responsible for the animal and for damage caused by it in accordance with the law. Detailed rules concerning the number and type of animals, cleaning, supervision and any restrictions: [do-uzupełnienia]. Any pet fee must be disclosed before the Booking is made.
  • 6. The following rules apply at the Holiday House:
  • a) smoking, use of e-cigarettes and similar devices: [do-uzupełnienia];
  • b) parties, receptions and events: [do-uzupełnienia];
  • c) quiet hours or other noise restrictions: [do-uzupełnienia];
  • d) use of a fireplace, barbecue, fire pit, sauna, hot tub, pool or other amenities, if available: [do-uzupełnienia];
  • e) waste sorting and the condition in which the Holiday House must be left on departure: [do-uzupełnienia].
  • 7. Guests must use the Holiday House, its equipment and grounds according to their intended purpose, comply with safety and fire-safety rules, and avoid disturbing neighbours.
  • 8. The Customer is responsible for the conduct of persons whom they allow to use the Holiday House, to the extent provided by law and the Agreement.
  • 9. The Customer should promptly notify the Accommodation Provider of any breakdown, damage, safety risk or other circumstance that may affect the stay.
  • 10. The Customer must leave the Holiday House in a condition consistent with ordinary wear and tear resulting from proper use. The Customer is not liable for normal wear and tear or circumstances for which they are not liable under the law.
  • 11. If damage is identified, the Accommodation Provider may seek compensation for the actual damage suffered under general legal rules. These Terms and Conditions do not impose automatic penalties or damage charges that were not disclosed in the Booking.

§ 9. Changes to and cancellation of a Booking; no-show

  • 1. The Customer may request a change of stay dates by contacting the Accommodation Provider at [do-uzupełnienia]. A change requires confirmation from the Accommodation Provider and depends on availability. It may require an additional payment or result in a refund of the price difference if the difference arises from a change in dates or scope of stay and is disclosed before the Customer accepts the change.
  • 2. The Customer may cancel a Booking under the terms set out in this section. As a flexible cancellation policy has been selected, the exact deadlines and refund amounts must be stated clearly before payment and in the Booking confirmation.
  • 3. The following cancellation terms apply:
  • a) cancellation at least [do-uzupełnienia] before the start of the stay: [do-uzupełnienia];
  • b) cancellation between [do-uzupełnienia] and [do-uzupełnienia] before the start of the stay: [do-uzupełnienia];
  • c) cancellation later than [do-uzupełnienia] before the start of the stay or a no-show: [do-uzupełnienia].
  • 4. A cancellation may be submitted by email to the address specified in § 1(3) or through another function available on the Website. The Accommodation Provider confirms receipt at the Customer's email address.
  • 5. Any refund due after an effective cancellation will be made within [do-uzupełnienia] using the original payment method, unless the Customer expressly agrees to another method that does not incur costs for the Customer.
  • 6. If the Guest does not arrive on the first day of the stay, the terms in paragraph 3(c) apply. Rules for a possible late arrival: [do-uzupełnienia].
  • 7. The Accommodation Provider may cancel a Booking only for justified reasons that prevent the Agreement from being performed, in particular if the Holiday House becomes unavailable for reasons beyond the Accommodation Provider's control or a safety risk arises. The Accommodation Provider will inform the Customer promptly and refund all amounts received for the service not provided, without prejudice to any other rights the Customer may have under the law.
  • 8. In exceptional circumstances, the parties will cooperate to find a lawful solution, taking into account the nature of the event and the rules governing contractual liability. These Terms and Conditions do not exclude the Accommodation Provider's liability where such exclusion is prohibited by law.

§ 10. Right to withdraw from the Agreement

  • 1. For an agreement concerning accommodation for purposes other than residential purposes, where a specific day or period of service is specified in the Agreement, the exception set out in Article 38(12) of the Polish Consumer Rights Act applies.
  • 2. Accordingly, a Consumer generally does not have the statutory 14-day right to withdraw from a distance contract for accommodation on a specific date or during a specified period.
  • 3. The absence of a statutory right to withdraw does not affect the right to cancel the Booking under § 9 or any rights arising under other mandatory provisions of law.
  • 4. If the nature of a particular agreement or the circumstances of its conclusion mean that the statutory exception in paragraph 1 does not apply, the right of withdrawal will be assessed under the provisions applicable to that agreement.

§ 11. Liability and complaints

  • 1. The Accommodation Provider performs the Agreement with due care and is liable for non-performance or improper performance in accordance with applicable law.
  • 2. The Customer may submit a complaint concerning, in particular, the Booking process, payment, operation of the Website, consistency between the offer and the service actually provided, or the stay itself.
  • 3. Complaints should be sent to the email address specified in § 1(3) or in writing to the Accommodation Provider's address specified in § 1(2). Where possible, a complaint should include details identifying the Booking, a description of the problem, the date it occurred and the requested outcome.
  • 4. Missing information does not deprive the Customer of their rights. If additional information is necessary to deal with the complaint, the Accommodation Provider may request it.
  • 5. Consumer complaints will be handled within 14 days of receipt where the law provides for that deadline for the relevant complaint. Failure to respond within the deadline has the effects specified by the applicable law where relevant to the request. In other cases, the Accommodation Provider will respond without undue delay.
  • 6. The response will be sent to the Customer's email address or by another method agreed with the Customer.
  • 7. These Terms and Conditions do not exclude or limit the rights of Consumers or individual entrepreneurs with consumer rights where the law grants them protection. They do not exclude liability for intentional damage or any other liability that cannot lawfully be excluded.

§ 12. Out-of-court dispute resolution

  • 1. A Consumer may use out-of-court complaint-handling and dispute-resolution procedures where available and appropriate for the dispute.
  • 2. Information about consumer assistance, including the relevant district or municipal consumer ombudsman and entities authorised to conduct consumer ADR proceedings, is available on the website of the Polish Office of Competition and Consumer Protection: https://uokik.gov.pl.
  • 3. Disputes with Customers who are not Consumers will be resolved by courts having jurisdiction under
